*  Charge for Late Submission
  If the Form CR109 is lodged with the Commissioner for endorsement after the said one month period, a fee of $310 is required to be paid for the endorsement.

*  Implication of Non-submission of Form CR109
  Under the Landlord and Tenant (Consolidation) Ordinance (Cap.7), a landlord or principal tenant shall not be entitled to maintain an action to recover the rent under the tenancy agreement unless the Commissioner has endorsed a Form CR109 for the agreement.

*  For Estate Agents
  If you are the estate agent and so authorised, please submit the Form CR 109 on behalf of the landlord soon after the signing of the agreement for a new tenancy or a renewal of tenancy in order to avoid the payment of the fee for late submission. Alternatively, if you are not so authorised, please prepare the Form CR 109 for the landlord's signature at time of signing the agreement and advise him to submit the form immediately. It should also be noted that the stamping of a tenancy agreement and the submission of a Form CR109 can be processed in parallel rather than one after the other. If you choose to process the stamping of the tenancy agreement first, please ensure timely submission of the Form CR 109 to avoid the late submission charge.
