Provision of Information to RVD Upon Letting


1. DOMESTIC TENANCIES

(i) Submit Notice of New Letting or Renewal Agreement (Form CR109) under Part IV of LTCO

The landlord/principal tenant or its representative/agent, including the estate agent so authorised, soon after entering into a new tenancy/sub-tenancy (including both fresh letting and renewal), is advised to submit Notice of New Letting or Renewal Agreement (Form CR109) to RVD within 1 month from the date on which the parties entered into a new tenancy/sub-tenancy or renewed a tenancy/sub-tenancy.

Mode of Serving Notice:

  1. Online Submission of Form CR109
  2. Personal Service or by post to RVD
    (Service by fax will not be accepted.)

Form CR109 can be obtained from

(ii) Submit Notice of Tenancy (Form AR2) under Part IVA of LTCO

The landlord of a regulated tenancy must complete and submit a Notice of Tenancy (Form AR2) to the Commissioner of Rating and Valuation (“Commissioner”) WITHIN 60 DAYS after the term of the tenancy commences or is taken to commence under Part IVA of LTCO. The landlord of a regulated tenancy may not maintain an action to recover any rent under the tenancy unless the notice is endorsed by the Commissioner.

Mode of Serving Notice:

  1. Online submission of Form AR2
  2. Personal service, courier or post to RVD
    (Service by fax will not be accepted.)

Form AR2 can be obtained from

(iii) Change in Payer's Particulars (Name and/or Correspondence Address)

The landlord/principal tenant or tenant is advised to notify RVD if there is any change in payer's particulars (name and/or correspondence address) by the following means:

  1. Form or Slip Submission

    Please complete and return one of the following form/slip to RVD by post, fax, email or in person:

    Form RVD1006 (Notification of Change in Payer's Particulars), which can be obtained from:

    Slip for Change of Payer's Particulars (at the back page of the Demand for rates and/or Government rent).

  2. Letter or Email

    To notify RVD by letter or email of the new payer's name, correspondence address and contact phone number. The property address and Account Number of the property should be quoted.

  3. Online Change of Payer's Particulars

    Note:
    To change payer's particulars online, you need to have the 15-digit Account Number of the property which is printed on the left-hand corner of the Demand for Rates and/or Government Rent.

Points to Note

(i) Form CR109

  • Free of Charge

    Form CR109 lodged with the Commissioner for endorsement within 1 month from the date on which the parties entered into a new tenancy/sub-tenancy or renewed a tenancy/sub-tenancy will be endorsed free of charge.

  • Charge for Late Submission

    If the Form CR109 is lodged with the Commissioner for endorsement after the said one month period, a fee of $310 is required to be paid for the endorsement.

  • Implication of Non-submission of Form CR109

    Under the Landlord and Tenant (Consolidation) Ordinance (“LTCO”), a landlord or principal tenant shall not be entitled to maintain an action to recover the rent under the tenancy agreement unless the Commissioner has endorsed a Form CR109 for the agreement.

  • For Estate Agents

    If you are the estate agent and so authorised, please submit the Form CR109 on behalf of the landlord soon after the signing of the agreement for a new tenancy or a renewal of tenancy in order to avoid the payment of the fee for late submission. Alternatively, if you are not so authorised, please prepare the Form CR109 for the landlord's signature at time of signing the agreement and advise him to submit the form immediately. It should also be noted that the stamping of a tenancy agreement and the submission of a Form CR109 can be processed in parallel rather than one after the other. If you choose to process the stamping of the tenancy agreement first, please ensure timely submission of the Form CR109 to avoid the late submission charge.

(ii) Form AR2

    Offence and Penalty

  1. The landlord of a regulated tenancy must complete and submit a Notice of Tenancy (Form AR2) to the Commissioner WITHIN 60 DAYS after the term of the tenancy commences or is taken to commence under Part IVA of LTCO. The landlord who refuses or neglects to comply with the requirement without reasonable excuse commits an offence and is liable on conviction to a fine at level 3 (HK$10,000), and in the case of a continuing offence, to a further fine of HK$200 for each day during which the offence continues.
  2. The landlord of a regulated tenancy may not maintain an action to recover rent under the tenancy unless the notice is endorsed by the Commissioner.

2. NON-DOMESTIC TENANCIES

The landlord or tenant or its representative/agent, including the estate agent so authorised, soon after entering into a new tenancy (including both fresh letting and renewal), is advised to take the following actions:

(i) Provide Rental Information to RVD

The landlord or tenant is advised to notify RVD of the rental particulars by one of the following means:

  1. Sending a copy of the tenancy agreement to RVD

    You may send a copy of the tenancy agreement to RVD by post, in person or by fax. Please provide (i) the assessment number of the property, (ii) the contact person and (iii) contact number when sending the tenancy agreement to RVD.

  2. Online Submission of Form R1A

    (Requisition for Particulars of Tenements)

    Note:
    To submit an electronic Form R1A, you need to enter either Assessment Number or R1A Number. Assessment Number can be found on the upper part of the Demand for Rates and/or Government Rent just below the Address or Description of Tenement. If you have received a hard copy of Form R1A recently (please refer to paragraph 2(i)(c) below), R1A Number is printed on the top left hand corner of the form.
     

  3. Alternatively, if you have received a hard copy of Form R1A from RVD, you may either complete and return it to RVD by post or in person, or submit the rental particulars online as mentioned in the above paragraph 2(i)(b).

(ii) Change in Payer's Name and/or Correspondence Address

The landlord or tenant is advised to notify RVD if there is any change in payer's name and/or correspondence address.

  1. Form or Slip Submission

    To change payer's particulars online, you need to have the 15-digit Account Number of the property which is printed on the left-hand corner of the Demand for Rates and/or Government Rent.

Point to Note

If you are the agent/representative acting on behalf of the landlord or tenant, you must have been authorised for so doing.
